ZURICH (Reuters) – The Federal Administrative Court has rejected Swisscom's complaint regarding the standards for the expansion of fiber optic networks for consumers, the court announced on Tuesday.
At the center of the case was the question of whether Swisscom could use a different standard than the one that the telecommunications companies had agreed upon in a round table with the supervisory authorities, the court said in a statement.
The Swiss Competition Commission had provisionally banned Swisscom from expanding its network until the conclusion of an investigation against which Swisscom had appealed in January.
"Swisscom was unable to convince the court that there were sufficient technological or economic reasons for a deviation from the fiber optic standard," she said in a judgment that can be appealed to the Swiss Supreme Court.
The telecommunications company regrets the court decision and believes the precautionary measures have been wrong.
"We are convinced that our behavior is fair and in accordance with antitrust law and will now think about our next steps," said Swisscom CEO Urs Schaeppi in a press release.
